Can Social Media Impact my Personal Injury Case?

In today’s digitally-based era, social media is a popular form of communication, connection, and expression. In fact, about 74% of adults who use the internet also use social media.

There are times, however, when sharing too much personal information can be detrimental. One of those times is when you have a pending personal injury case. Here, we discuss why using social media can hurt your case and what to avoid posting.

Social Media Used Against You

An injury can leave you with a variety of emotions, some of which you may want to share online. However, think twice before you hit the “send” button.

Why? The person investigating your case (the defendant) will be doing everything they can do show that your injuries are not what you claim them to be. One way they can do this is by looking at your social media accounts.

Your social media account may inadvertently show that you are physically able and capable of living your normal life. Your posts may contradict your testimony and the defense will try to claim that you aren’t seriously injured and therefore do not deserve the compensation you are pursuing.

“But I’ll be careful about it!” This is something that many individuals think. However, it’s all too easy to say something that can be used against you. Even posting something that is seemingly innocent can your chances at receiving compensation for your injury case.

Photos of you hiking, a check-in at a concert, or a simple status update could all be used against your case and hurt your chances at receiving what you need to heal. We suggest avoid posting:

  • Check-ins

  • Photos of you participating in activities

  • Photos of you with alcohol beverages

  • Anything related to your personal injury case
